What is a sworn translation?

Sworn translations represent the level of the Client and the Spanish Administration in the field of language translation and interpretation. The sworn translation must be signed and stamped by an authorised sworn translator (sworn translator-interpreter).

A sworn translation is a translation service that requires official certification signed and stamped by a sworn translator-interpreter duly qualified, appointed and registered with the Spanish Ministry of Foreign Affairs and Cooperation, which is why sworn translations require sworn translators who are experts in this type of work.

It has ‘official’ status before the official authorities and before the courts. In the latter case, only the judge can reject it with a very reasoned decision, which will probably happen in very few cases. For the sworn translation to be official, it must bear the signature, stamp and certification of the sworn translator.

What is legalising a document?

This is an administrative act that grants validity to a foreign public document, verifying the authenticity of the signature affixed to a document and the capacity in which the authority signing the document has acted. Unless there is a legal instrument that exempts from this obligation, all foreign public documents must be legalised to be valid in Spain and all Spanish public documents must be legalised to be valid abroad.

What is the Hague Apostille and what is it for?

Where is it done?

If the country of destination of the document to be legalised is not a signatory to the Hague Convention, it will have to be legalised by the consular authority of that country.

What about private documents?

Only public documents can be legalised. Therefore, in order to legalise a private document (e.g. minutes of a general meeting), the easiest way is to go through the notary's office by means of a notarial deed.

Through the so-called Hague Apostille, a Hague Convention signatory country recognises the legal effectiveness of a public document issued in another Hague Convention signatory country. The single legalisation procedure - known as apostille - consists of placing an apostille or annotation on the public document itself, which certifies the authenticity of the public documents issued in another country.

The signatory countries to the XIIth Convention of the Hague Conference on Private International Law of 5 October 1961 therefore recognise the authenticity of documents that have been issued in other countries and bear the apostille.

Vocational training recognition

Vocational Education and Training (VET) is non-university education, the main purpose of which is to train people to carry out a professional activity. Therefore, VET studies are aimed at acquiring professional skills that enable people to carry out different jobs and respond to the need for qualified personnel specialised in the different sectors of the labour market. VET in Spain offers more than 150 training cycles within 26 professional families, with theoretical and practical contents adapted to the different professional fields.

Basic Vocational Training Cycles, which lead to the corresponding basic vocational qualification and are compulsory and free of charge.

Intermediate Vocational Training Cycles, which lead to the title of Technician and form part of post-compulsory secondary education.

Higher Level Vocational Training Cycles, leading to the Higher Technician qualification which is part of higher education.

FOREIGN UNIVERSITY DIPLOMAS

The Spanish Ministry of Education establishes two different procedures, accreditation and equivalence. In this section, we will refer to accreditation reserved for regulated professions.

ACCREDITATION PROCEDURE (REGULATED PROFESSIONS)

This procedure can be used to request the recognition of a foreign higher education degree as an official Spanish Bachelor's or Master's degree that gives access to a regulated profession in Spain.

The recognition grants the foreign degree, from the date on which it is granted and the corresponding credential is issued, the same effects as the Spanish degree to which it is recognised throughout the national territory, and makes it possible to exercise the regulated profession in question under the same conditions as the holders of Spanish degrees that enable them to do so.

A regulated profession is understood to be the activity or set of professional activities for the access, exercise or modality of exercise of which it is required, directly or indirectly, to be in possession of certain professional qualifications, by virtue of legal, regulatory or administrative provisions.

Equivalencia

QUALIFICATION EQUIVALENCE

This procedure can be used to request the equivalence of a foreign higher education qualification to a degree and to an academic level of official university Bachelor's or Master's degree in specific fields and branches of knowledge.

The declaration of equivalence grants the foreign qualification, throughout the national territory, from the date on which it is awarded and the corresponding certificate is issued, the same academic effects as the qualifications that are included in the specific area and field of training to which it has been declared.
